Terms of Service
Effective date: June 2026 — WellNest Scribe
1. Acceptance
By accessing or using WellNest Scribe (“the Service”) you agree to be bound by these Terms. If you are using the Service on behalf of a healthcare facility, you represent that you have authority to bind that organisation to these Terms.
2. Intended Use
WellNest Scribe is a clinical documentation aid. It is not a substitute for professional medical judgment. All AI-generated notes must be reviewed, edited, and approved by a qualified clinician before being used for clinical decision-making, billing, or any other purpose. The clinician who approves the note bears sole responsibility for its accuracy and completeness.
3. Patient Data & Privacy
You are responsible for:
- Obtaining informed verbal consent from patients before recording any consultation.
- Ensuring your use of the Service complies with applicable data protection law, including the Jamaica Data Protection Act 2020, the Trinidad & Tobago Data Protection Act 2011, the Barbados Data Protection Act 2019, and any other applicable Caribbean or national legislation.
- Not recording sessions involving minors without appropriate guardian consent.
- Marking encounters containing HIV status, mental health, reproductive health, or substance-use information as “Sensitive” using the platform flag.
WellNest Scribe stores patient data encrypted at rest. Audio recordings are automatically purged after 30 days (configurable by your administrator). You must ensure your organisation’s data retention policy aligns with this setting.
4. AI-Generated Content Disclaimer
The AI models used by this Service can make errors, omit information, or misinterpret speech. Always verify:
- Drug names, doses, and allergy mentions against your own notes.
- Patient demographics and identifiers before filing any note.
- Any clinical flag or safety warning surfaced by the AI.
WellNest provides the Service “as is” without warranties as to accuracy or fitness for a particular clinical purpose.
5. Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with other individuals. The Service implements an automatic screen lock after a period of inactivity; you are responsible for ensuring your device is secured when not in use. Suspected unauthorised access must be reported to your administrator immediately.
6. Prohibited Uses
You must not:
- Attempt to access another user’s sessions or notes.
- Use the Service to record individuals without their knowledge or consent.
- Export, copy, or transmit patient data outside the platform except as expressly permitted by your organisation’s policy and applicable law.
- Share login credentials or circumvent authentication controls.
- Attempt to reverse-engineer the AI models or extract training data.
7. Data Breach Notification
WellNest will notify affected administrators within 72 hours of becoming aware of a confirmed breach involving personal data, consistent with requirements under the Jamaica Data Protection Act 2020 and equivalent Caribbean legislation. Organisations are responsible for their own downstream notification obligations to patients and regulators.
8. Limitation of Liability
To the fullest extent permitted by law, WellNest shall not be liable for any clinical outcome, missed diagnosis, or patient harm arising from reliance on AI-generated documentation. The Service is a documentation tool, not a diagnostic system.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after notification of changes constitutes acceptance. Material changes will be communicated by email to account administrators.
10. Governing Law
These Terms are governed by the laws of Jamaica. Disputes shall be resolved in the courts of Jamaica, without prejudice to your rights under applicable consumer or data protection law in your own jurisdiction.
